We have been informed that the Senate and House Special Committees on Workers’ Compensation are now reviewing the statements and reports they have been provided over the past three weeks concerning the need for reform of the Illinois Workers’ Compensation Act, and they are discussing proposed amendments to the Act at this time. Our firm continues to follow these developments through our involvement with the Illinois Chamber of Commerce Employment Law Council’s Workers’ Compensation Committee, and we are actively participating in dialogue regarding the adoption of “primary cause,” or a similar causation standard, for the proof necessary to establish a claimant’s entitlement to benefits for a compensable work accident.
We welcome any thoughts or comments you may have, and we will continue to provide you with updates as the legislators continue working on this through the holiday season.
