Our firm’s philosophy with respect to litigation management is quite simple: We employ an early recognition strategy in the handling of all of our defense referrals. Within 48 hours of receipt of a file, an opening review letter is prepared and forwarded to the claims representative detailing the facts and medical history for each case, and addressing the compensability, liability, and trial exposure issues.

In the initial review letter, recommendations are listed (in checklist form), concerning the future handling of each claim. We then diary drop dead dates (usually 30-60 days) for completion of the recommendations and for the formulation of a specific and final written action plan. Each file is then appropriately identified, (e.g., settlement, litigate, other action) and aggressively moved forward toward resolution working with the claims representative.

Inman & Fitzgibbons takes a team approach to each case, working together with the claims representative and company representative to resolve the litigation as quickly as possible. We understand that it is usually the claims representative’s responsibility to investigate and generally work up a claim. As defense counsel, we view our role as providing legal guidance and analysis, participating in the litigation process, aiding and expediting the settlement process, and providing necessary legal expertise through the trial phase of the litigation.
